摘　　要：1背景概述 2005年4月13日，因余祥林的妻子完好无损的回到了家，法院重新审理了余祥林的“杀妻案”，宣判余祥林无罪；和余祥林案有着惊人的相似，2010年5月9日，同村的被害人活生生的回到了家，使得被关押多年的赵作海洗清冤屈，法院重新审理，被宣告无罪释放。在现代社会，我们很难相信这样的冤假错案会发生。in recent years, with the development of the concept of law as well as the enhancement of the power of the media, unjust phenomenon occurs frequently in the judicial practice. The miscarriages of justice not only bring great pain to the party, but also make a challenge to the credibility and impartiality of the judicial. The author analyzes the reasons of miscarriages of justice status, the causes, and put forward the corresponding measures to reduce or even avoid miscarriages of justice.
