从“双一流”建设谈政府与大学的关系

摘　　要："双一流"建设的提出,进一步突破了以往政府在大学管理活动中一面独大的固化格局,呈现出"政-校"共治模式;政府对资源控制的绝对化得以改观,办学经费拨款呈现多方参与格局;第三方参与保障了大学动态化管理的可行性,政府与大学间呈现出多维关联的特殊性。与此同时,"双一流"建设亦充斥着政府行政管理权、教育统筹权与大学办学自主权、学术自由权之间权利关系的矛盾统一性。要处理好"双一流"建设中政府与大学之间的关系,须以法厘清二者间的权利边界、以理性民主规约二者间的合理权限、以多方共治保障二者间的权利融洽。The proposal of ＂ Double World-class＂ construction has further broken through the previous fixed pattern of the government′s dominant role in the management of universities and shown a ＂ Government-university＂ co-governance model.The government′s absolute control of resources has improved,and the appropriation of university running funds presents multiple participation.The participation of the third party guarantees the feasibility of dynamic management of universities,and the particularity of multidimensional association between the government and the university is shown.At the same time,the construction of ＂ Double World-class＂ is also full of the contradictory unity of the government administrative power,overall planning power of education,autonomy in running a university and the right of the academic freedom.To deal with the relationship between the government and the university during the construction of ＂ Double World-class＂,we should clarify the right boundary between the two by law,stipulate the reasonable authority between the two by rationalism and democracy,and to protect the harmony of rights between the two by multiple governance.
