摘  要:惩戒是学生管理的必要手段,是教师的工作职责之一。公立学校的教师惩戒权隶属于公权力的范畴,遵循"法有授权才可为"的原则。目前,我国关于教师惩戒的立法存在授权模糊、惩戒方式少、性质单一、没有针对性等问题,不利于维护正常的教学秩序与保障学生的合法权益。相关教育立法可以引入教师惩戒权的概念、增加教师惩戒的种类与方式、明确各种惩戒方式合法行使的具体条件,以完善现有的教师惩戒制度。Discipline is a necessary means of student management and also one of the teacher's job responsibilities. The teacher's disciplinary authority in public schools is a kind of public authority, ,following the principle of "one can only do what the law has authorized". At present, there exist in the field of teachers' disciplinary legislation in China such problems as unclear authorization of disciplinary right, less disciplinary methods, single nature, not targeting at the specific behavior, all of which is not conducive to the maintenance of normal teaching order and the protection of legitimate rights and interests of students. To improve the teacher's disciplinary system, relevant educational laws and regulations can introduce the concept of teacher's disciplinary right, add the disciplinary types and methods and make clear the specific conditions of all kinds of disciplinary methods.
