摘 要:当前,我国教育法治建设虽已取得一定成就,但仍面临新的挑战。教育立法理念、内容、速度和质量无法因应现代教育发展的新动向、新类型和新样态;教育执法体系不能适应教育治理的转型需要;教育纠纷解决机制无法满足权利救济的及时、有效和多元需求。为此,需要从中国实践出发,加快教育立法进程,完善教育法律体系;规范教育执法行为,创新教育执法机制;肯定教育诉讼价值,完善纠纷解决机制。如此,方能稳步推进中国教育法治现代化。Although China has made some achievements in the development of educational governance based on the rule of law, there are still many new challenges ahead. The ideas, content, speed and quality of educational legislation cannot keep up with the new trends, new types and new patterns of modern education; the educational law enforcement system is not adapted to the transformation of educational governance; the educational dispute settlement mechanism cannot satisfy the timely, effective and diverse demand for right relief. In order to steadily advance the modernization process of rule of law in the field of education, it is imperative for China to speed up the process of educational legislation, improve the legal system on education, standardize the implementation of educational law enforcement, innovate the mechanism of educational law enforcement, affirm the value of educational litigation, and improve dispute resolution mechanisms.
