刍议我国宅基地使用权的空间权构建

摘　　要：由理论与现实存在的实际困境导入,通过回溯农村宅基地使用权的逻辑演进,厘清农村宅基地使用权的发展路径或模式,进而为破解实际困境提出了构建空间权的解决途径;之后分析了构建我国农村宅基地使用权之空间权制度的应然性与探索有中国特色的宅基地使用权之空间权;最后,对我国农村宅基地使用权之空间权的构建提出了具体制度建议,包括宅基地使用权的量化与德国的居住权制度的引入。The article was introduced by the actual dilemma of theory and reality. By using the logical evolution of housing land use right,clarify the development path of housing land use right or schema,and then build space was put forward for solving practical difficulties of solutions,after the analysis of the construction of inevitability of rural housing land use right of space right system and explore with Chinese characteristics of housing land use right of space right. Finally,put forward the specific institutional proposals for the construction of the space right to the right of use of the rural homestead in China,including the quantification of the right to use the homestead and the introduction of the residence right system in Germany.
