试论父母教育权与其他教育权的关系——以“孟母堂”事件为切入点

摘　　要："孟母堂"事件为我们提供了一种新的视角来关注并重新解读父母教育权与学校教育权和国家教育权之间的关系。父母教育权与学校教育权、国家教育权之间关系处理的重点在于确保儿童的最大利益,在合理行使父母教育权的同时,充分运用学校教育权与国家教育权,与公共教育体系达成一种良性互动与合作的关系,从而促进父母教育权与学校教育权和国家教育权之间的平衡与协调。The case of " Mengmu Tang"has provided us with a new perspective to focus on and reinterpret the relationship of parental education right,school education right,and state education right. The best interest of children is the emphasis in dealing with the relationship of those three education rights. While exercising the parental education right reasonably,we can make full use of school and state education rights to make parental education right achieve a beneficial interaction and cooperation with the public education system. Therefore,a balance and coordination relationship among those three education rights will be promoted.
