我国航空旅客行程延误处置法律制度的构建

摘　　要：在我国航空旅客运输实践中,航班延误、航班超售与航班取消致使旅客行程延误常有发生,而航空公司对旅客行程延误的处置却存在损害旅客权益的现象。借鉴欧盟航班拒载、取消与延误下旅客权益保护法律制度,文章统一把航班延误、航班超售与航班取消归结到旅客行程延误中进行旅客行程延误处置法律制度构建的讨论。在这一制度的构建中,需要确保旅客对行程延误原因及航班超售实情的知情权;需要完善旅客行程延误赔偿法律制度以确保旅客求偿权的实现,区分合理行程延误和不合理行程延误的赔偿,并对赔偿范围和赔偿责任限额作出规定。In China’s air passenger transportation, flight delay, flight overbooking and flight cancellation result in trip delayfrequently. But airlines ’ disposal of passengers ’ travel delay often harms passengers ’ rights and interelegal system that protect passenger rights and interests against flight rejection, cancellation or delay, this legal system to handle passenger trip delay that covers flight delay, flight cancellation and flight overbooking. Such a law should ensure passengers the right to knowthe delay reasons and the oversold fact,and ensure the compensation course,compensation for reasonable travel delay and unreasonable travel delay should be distinguished,and the scope of compensationand limits of liability be provided.
