摘 要:利尔案和谢波德案的案情和司法判决的比较表明,美国司法机关在处理教师的职称评审纠纷案中确立了一致的有限审查标准:基于合同的程序性审查,即针对程序上的合法性进行审查,以合同为依据,不涉足实质评审内容合理性的审查。鉴于司法介入的有限性原则和校内申诉机构缺位的现实性,在合同法的框架下明确评价程序和规则、确定科学的评价指标体系以及完善评审结果的校内纠纷解决机制是规范今后高校教师职称评审工作,有效解决教师职评审纠纷乃至进一步推进大学依法治校的可行路径。A comparative analysis of the facts and judicial decisions of Lill and Shepard cases shows that the US courts have established a consistent limited judicial review criteria in dealing with the promotion and tenure disputes between the universities and the professors: a procedural review based on contract,which is a review of the legitimacy of the procedure to the contractual agreement,not of the rationality of the substantive content. Considering the principle of limited judicial intervention and the reality of the absence of the internal grievance institutions,under the contract law framework,the clarification of the procedures and rules,the determination of the evaluation system and perfection the review disputes settlement mechanism are the effective ways for the review of the teacher's promotion,effective settlement of disputes and carrying forward the managing the universities by law.
