摘　　要：《英雄烈士保护法》第25条制度化确立英烈保护公益诉讼,将其作为保障社会公共利益和实现社会正义的重要渠道。社会正义理论是支撑与推动英烈保护民事公益诉讼的发展并促其持续迸发制度活力的核心脉络。将社会正义的理念和精神妥适地嵌入其中,采行社会正义所重视的倾斜保护原则,在程序上倾斜保障法院与检察院的程序主体地位并施以更重的程序责任,是合理配置英烈保护民事公益诉讼程序保障的基本原则。检察机关应予妥当积极地运用公益诉权,以检察担当精神切实担负起国家所施加的维护社会公共利益的责任。法院亦顺应现代民事司法改革强化司法职权的时代潮流,综合利用民事诉讼法律规范所赋予的各项司法职权,适时地生成社会正义。Article 25 of the Law of the Protection of Heroes and Martyrs institutionalizes and establishes the hero and martyr-protection civil public interest litigation as an important channel for safeguarding social public interests and realizing social justice. The theory of social justice is the core structure that supports and promotes the development of civil public interest litigation,and also provokes the vigor of the system continuously. While the reasonable arrangement of the procedural safeguards for the hero and martyr-protection civil public interest litigation,the concept and spirit of social justice must be appropriately embedded in it,so as to adopt the principle of tilt protection,which is attached importance by social justice,to protect the procedural main body status of courts and procuratorates with tilt,and to impose more procedural responsibilities on them in process.The people＇s procuratorates should properly and positively exert the right of public interest action,shoulder the procuratorial responsibilities with the spirt of earnest actually,which are imposed by the state to safeguard public interests. The court also should comply with the epochal trend to strengthen judicial powers in modern civil judicial reforms,and exert various judicial powers conferred by the legal norms of civil procedural law comprehensively to generate social justice in a timely manner.
