摘　　要：《民法总则》所确立的法人分类新模式,使我国的民办学校分类管理有了确切标准。可依据《民法总则》的法人分类新模式,确定营利性民办学校与非营利性民办学校分类管理的理论逻辑。具体而言,可从营利性民办学校的含义与性质、内部治理结构、特殊规则等方面确定营利性民办学校发展的理论逻辑,从非营利性民办学校的含义与性质、内部治理结构等方面确定非营利性民办学校发展的理论逻辑。The new mode of legal person classification established by General Provisions of Civil Law has set a precise standard for private school classification management. According to the new mode of legal person classification of General Provisions of Civil Law,we can define the theoretical logic of private school classification management. In particular,we can determine the theoretical logic of for-profit private school development from the meaning,nature,internal governance structure and special rules of for-profit private school. Determine the theoretical logic of non-profit private school development from the meaning,nature and internal governance structure of non-profit private school.
