摘 要:市场对应用性教育的巨大需求,推动了美国营利性大学的崛起。营利性大学以股权投资为基础,衍生出以利润为中心的治理模式。就混合所有制职业院校而言,股份制是其基本的生产组织形式,其营利的正当性源于资本能自行增殖并带来剩余价值的特性,以及应用性知识的交易价值。对混合所有制职业院校的机构性质与法人属性定位,需要突破所有制视角下的公办、民办思维,以是否营利作为确定学校法人性质的基本标准。当前,吸引和鼓励社会资本参与职业教育改革发展的前提是破除制度瓶颈,以营利性为前提进行科学合理的顶层设计。The huge demand for the applied education in the market has driven the rise of for-profit colleges in the United States. Forprofit colleges, based on equity investments, derive a profit-centric governance model. As far as the mixed-ownership vocational colleges are concerned, the shareholding system is the basic form of production organization, and the reason why their profits are legal is that the capital can proliferate and bring the surplus value and the applied knowledge has the transaction value. Orientating the nature and the legal person's property of mixed-ownership vocational colleges depends on whether they can make profits as a basic standard, which needs to break through the public and private thoughts under the perspective of the ownership system. At present, the premise of attracting and encouraging social capital to participate in the reform and development of education is to break the system bottleneck and place profits first to make scientific and reasonable top-level design.
