澳门新高教法的制定、完善及未来展望

摘　　要：经过十五年的起草和准备,澳门新高等教育法(第10/2017号法律"高等教育制度")于2017年7月出台。通过文献分析法和专家访谈法,比较分析了澳门新旧高教法在教育素质保证、院校治理、课程设置、教学人员资格、人才培养和教育资助等六个方面的差异。研究发现,新法突破了旧法"妨碍澳门高等教育发展"的局限,比较全面地规定了高等教育的服务标准和基本制度,实现了六个方面的制度突破。但是,未来仍需要进一步健全澳门高等教育法律制度体系、明确法律责任,从而更好地推行依法治教。In July 2017, the new higher education law in Macao （Law 10/2017, ＂Higher Education System ＂）finally published after 15 years long-awaited revision. To better promote the implementation of the new highereducation law, this paper, compares and analyzes the new and previous higher education law in Macao in terms ofeducation quality assurance, college governance, curriculum design, teaching staff qualification, talentdevelopment and education supports. The study finds that the new law breaks through the hinders of Macao highereducation development in the precious law, and fully sets the service standards and basic system of highereducation which achieves institutional breakthroughs in the above six aspects. However, it is necessary to furtherimprove the legal system of Macao higher education and clarify its legal responsibilities as to better strengthenpropaganda of educational idea of rule of law.
