法律硕士司法实战能力培养的不足与教法革新

摘  要:国家提出的"卓越法律人才计划"对法律专业硕士实战能力明确了具体要求。但在现有的法学教育中,以模拟法庭培养法律硕士的方式存在言辞辩论沦为话剧表演、实体法适用训练效果低微、调查取证能力得不到锻炼、得到训练受众较少等问题,没能真正培养学生的司法实战能力。对此,应选择对抗性案例、真实模拟分组,仿真调查取证、及时点评四步教学法,以有效培养和提高法律硕士的司法实战能力。Clearly-defined specifications are presented in the State's "Outstanding Legal Talents Program" about judicial practical competence for Master of Law major. However, in the existing legal education, court simulation-based cultivation of master of law witnesses degeneration of verbal debation into a drama, low substantive law application-based training effects, lack of cultivation of investigation-based evidence collection ability and small numbers of the specially-trained audiences, which makes it impossible to cultivate students' judicial practical competence. Accordingly, the four-step teaching method of "confrontational cases →real simulation grouping →simulation investigation-based evidence →collection timely comments" should be adopted in an effort to effectively cultivate and promote master of law students' judicial practical competence.
