摘  要:非法吸收公众存款罪的传统适用标准使得该罪的打击范围在P2P网络借贷领域不断扩张,不当阻碍了网络金融的创新和发展。学界对非法吸收公众存款罪的既有解释仅是在刑法视域内进行逻辑层面的推演,忽视了本罪作为空白罪状的特性,没有充分结合具体的金融管理法规等前置性法律规范的要求,使得解释结论缺少法律规范支撑,与网络金融管理实践不符。本罪是典型的行政犯,具有双重违法性特征。应该在法益保护原则指导下,充分结合相关金融管理法规探究其“非法性”的具体内涵,总结出本罪在网贷领域的违法行为类型,使本罪所保护的金融秩序具体化、明确化,以此来界定网贷行为的入罪边界,避免过分干预经济自由。The traditional application standard of illegal absorption of public deposits crime has caused the scope of the crime expanding continuously in the field of P2P online lending, which improperly squeezed the innovation and development of network finance. The existing interpretation of academic circle ignore the characteristics of this crime as a blank crime, and only carry out its logical deduction within the criminal ju- risprudence and fail to fully combine the specific financial management regulations and other predisposition legal norms. The conclusions lack of legal support and are inconsistent with the practice of network financial management. This crime is a typical administrative criminal with double illegality. The specific connotation of "illegality" should be explored by combining financial management regulations under the guidance of the principle of legal interests protection. This paper summarizes the types of illegal behaviors of this crime in the field of online lending, so as to make the financial order protected by this crime concrete and definite. Only in this way can we define the crime boundary and avoid undue interference in economic freedom.
