高校职务犯罪治理实证研究——基于103个高校职务犯罪案件的分析

摘　　要：随着我国高等教育的发展以及高校参与社会经济活动的日益频繁,高校职务犯罪呈现多发态势。高校职务犯罪的特征表现为犯罪主体文化程度较高、发案领域比较集中、作案手段比较隐蔽、危害性较大。高校职务犯罪既具有公权力犯罪的一般规律,又具有其生成的特殊规律。高校职务犯罪的成因在于高校行政权监控缺失、市场经济规则浸入高校管理活动、某些领导干部心理失衡。高校职务犯罪治理应坚持的原则是:教育、制度、监督相结合,突出重点、提前预警,以及法治的原则。With the development of higher education in China and the increasing participation in social and economic activities,duty crime in institution of higher education shows multiple trends.Subject of crime has higher education;the field of crime is more concentrated;the means of crime are hidden;and the consequences are serious in duty crime of institution of higher education.The duty crime in institution of higher education has not only the general law of the crime in public power,but also its special law.The reason of duty crime of university lies in the lack of supervision of administrative power and rules of market economy into management of university.The management of duty crime in university should insist on the principle of the combination of education,system and supervision,and the principle of early warning and the principle of the rule of law.
