摘 要:我国刑事诉讼法与监察法之间的衔接需要建立在准确把握其中的政治逻辑的基础之上。这种政治逻辑蕴含于立法过程的博弈之中,并且凝结为监察法所设定的权力关系和利益格局。在二者衔接问题上存在基于不同价值取向而产生的认知分歧,这种分歧集中地体现为对监察机关权力边界的设定,具体而言主要是律师对监察机关调查活动的介入、检察机关对监察机关的约束这两个方面。依循政治逻辑,在监察法已经制定并实施的背景下,刑事诉讼法的修改应以监察法确定的基本格局为参照标准,以此实现两部法律之间的有效衔接。政治逻辑的存在,意味着"两法衔接"中的价值分歧无法完全消弭,最终的价值权衡依然取决于立法过程的博弈以及政治判断的做出。The connection between the Criminal Procedure Law and the Supervision Law needs to be based on accurately grasping the political logicThis kind of political logic is contained in the game of the legislative process and is condensed into the power relations and interests set by the Supervision LawThere are cognitive differences based on different value orientations on the convergence of the twoThis disagreement is concentrated in the setting of the power boundary of the supervisory authoritySpecifically,it is mainly the involvement of lawyers in the investigation activities of the supervisory organs,and the restraint of the procuratorial organs to the supervisory organs.These two aspects of the constraints of the supervisory authorityFollowing the political logic,under the background that the Supervision Law has been formulated and implemented,and the supervision system has been formally established,the revision of the Criminal Procedure Law should be based on the basic pattern determined by the Supervision Law,so as to realize the.effective connection between the twoThe existence of political logic means that the value differences in the“the convergence of two laws”cannot be completely eliminated,and the final value trade-off still depends on the game of the legislative process and the making of political judgment.
