民办高校教师劳动权益保障机制研究

摘　　要：习近平总书记在十九大报告中指出要"支持和规范社会力量兴办教育",分析其内涵其实就是在支持和鼓励民办教育,因此重视和加强民办高等教育势在必行。《民办教育促进法》和《劳动合同法》对于民办高校教师与高校之间的劳动合同性质及其劳动关系的确定提供了法律依据,但因民办高校法律属性的不同,致使民办高校教师劳动关系具有复杂性和不稳定性。本文针对这些问题提出了完善和解决的对策设想。Xi Jin-ping general secretary in the big report to support and standardize the social forces to run education",analyzing its connotation is in support and encourage private education,therefore attaches great importance to and strengthen the private higher education is imperative."Private education promotion law"and"labor contract law for private colleges between teachers and university to determine the nature of labor contract and labor has provided a legal basis,but different attributes of the law for private colleges,the non-governmental university teachers'labor relationship has complexity and instability.This paper puts forward some countermeasures to solve these problems.
