摘  要:我国双语教育法制化过程是在《中华人民共和国宪法》《中华人民共和国教育法》的框架范围下呈现出独具特色的法律体系结构,引导着我国少数民族教育走上了依法治教的道路。双语教育政策实施的法理逻辑表达了双语教育发展内在本质所固有的规律性,主要表现出作为教育本根、教育遵循、法理内涵以及法治规律的法理逻辑,突出了鲜明的族性特征与教育发展思维,对我国双语教育政策的有效实施、民族教育事业的发展以及民族地区经济社会的繁荣发展具有重要的现实意义和实践价值。The process of legalization of bilingual education in China presents a unique legal system structure within the framework of the Constitution of the People s Republic of China and the Education Law of the People s Republic of China,which guides the education of ethnic minorities in China onto the road of governing education by law.The legal logic of the implementation of bilingual education policy expresses the inherent regularity of the development of bilingual education,which mainly manifests the legal logic as the root of education,the following of education,the connotation of jurisprudence and the rule of law.It highlights the distinctive ethnic characteristics and educational development thinking.It also has important practical significance and practical value for the effective implementation of bilingual education policy,the development of ethnic education and the prosperity and development of economy and society in ethnic areas.
