摘  要:随着职业教育发展形势变迁,修订《职业教育法》显得迫在眉睫,受到社会各界关注。具体而言,当前提出《职业教育法》修订动因,主要体现在其因工具本位立法取向、立法技术尚不成熟、相关主体权利义务不对等造成权威性不显等方面。修订《职业教育法》的时机现已成熟,职业教育迅猛发展、地方职业教育立法经验积累、中央层面屡屡出台的政策支持、学界深入研究积淀等都为《职业教育法》修订提供了实践基础。在新的历史时期,《职业教育法》修订应抓住学生职业教育权利保障、校企合作规范性、现代职业学校制度构建以及职业教育法律地位提升等关键问题,为职业教育发展提供有力制度保障。With the development of Vocational education,it is urgent to amend the Vocational Education Law.Specifically,the motivation for the revision of the Vocational Education Law is mainly reflected in the following aspects:the orientation of tool-based legislation,the immaturity of legislative technology,and the lack of authority caused by unequal rights and obligations of the relevant subjects,and so on.The time is ripe for revising the law of Vocational Education.With the rapid development of Vocational education,the accumulation of legislative experience in local vocational education,and the repeated promulgation of the Law at the central level.Policy support and in-depth academic research have provided practical basis for the revision of the Vocational Education Law.In the new historical period,the revision of the Vocational Education Law should focus on the key issues such as the protection of students'vocational education rights,the standardization of school-enterprise cooperation,the modern vocational school system and the improvement of the legal status of vocational education,so as to provide a strong institutional guarantee for the development of vocational education.
