摘  要:幼儿教师是保障学前教育事业健康发展的关键因素。由于法律地位与权利义务的模糊导致幼儿教师在现实中出现身份迷失。通过法教义学推导得出幼儿教师权利的本质是幼儿教师作为一个整体而享有的基于专业的职业权利,具有专业性与职业性,在现行法中可将幼儿教师的权利分层为幼儿教师的劳动者权利、一般性职业权利及特殊性职业权利。应基于劳动者、教师及幼儿教师三种身份组成幼儿教师权利框架,以期实现幼儿教师这三种身份在法律上的归位。Preschool teachers are a key factor in ensuring the healthy development of preschool education. Due to the ambiguity of legal status and rights and obligations,preschool teachers generally are in the loss of identity. From the perspective of the dogmatics of law, the essence of the rights of preschool teachers is the special professional rights they enjoy as a whole. Therefore, in the current law, the rights of preschool teachers can be divided into the labor rights, general occupational rights and special occupational rights. The author suggests that the rights of the preschool teachers should be formed according to the three different identities of the preschool teachers, as the workers, as the teachers and as the preschool teachers. Only in this way, the three identities of the preschool teachers can be in the status of legal regression.
