基层法院对县域经济发展的回应形态及其形塑机理——兼评司法地方保护主义话语

摘　　要：县际竞争推动的县域经济发展是促进实现中国经济奇迹的重要因素。包括法院在内的县域政权体系,均参与到由地方党委政府主导的县域经济发展之中。基层法院在此过程中形成了具有较强自主性的回应形态,这种回应形态为法院独立行使审判权保持了较大的自主空间,同时也有助于法院在县域经济发展中发挥一定的作用。将法院参与地方经济发展视为“司法保护主义”的批评话语,忽视了司法地方保护主义得以发生的初始条件已经明显改变,未将所有制、经济发展模式、经济结构等方面因素纳入对此问题的综合考量之中,缺乏对法院参与地方经济发展具体方式的经验性把握,以至于放大了司法地方保护主义在目前的普遍性。需要全面认识基层法院在县域经济发展中的作用及其限度,避免可能存在的偏失,合理设定司法体制改革方向,从而保证司法公正。The development of county economy promoted by inter-county competition is an important factor to promote the realization of China’s economic miracle. The county regime system, including the court, participates in the county economic development led by the local Party committee and government. In this process, the grassroots court has formed a response form with strong autonomy, which has maintained a large autonomy for the court to exercise judicial power independently, and it also helps the court to play a certain role in the development of county economy. The court’s participation in local economic development is regarded as a critical discourse of “judicial protectionism”. It ignores that the initial conditions of judicial local protectionism has changed significantly. The factors such as ownership reform, economic development model, and economic structure have not been included in the comprehensive consideration of this issue. It lacks an empirical considerations of the specific ways in which the court participates in local economic development, so that it magnifies the current universality of judicial local protectionism. It is necessary to fully understand the role and limits of grassroots court in county economic development, avoid possible deviations, and rationally set the direction of judicial system reform to ensure judicial justice.
