摘 要:船舶扣押反担保问题无论在理论界还是实务界都一直存有争议。2018年英国高等法院在The“MV Alkyon”案中确认扣船申请人无须提供扣船反担保是沿袭已久的程序惯例,再次将这一问题引入了人们的视野。分析船舶扣押反担保的不同立法模式,论证船舶面临解扣风险时提供反担保的正当性,进而考察中国船舶扣押反担保的制度现状并提出完善建议。The recent English case The “ MV Alkyon” aroused further concern over the controversial issue whether a cross-undertaking should be provided for arrest of ship. In the judgement, the Admiralty Judge confirmed that it was the court’s long-standing practice that a cross-undertaking was not required. This paper briefly introduces various legislation modes of cross-undertaking for arrest of ship, analyses the legitimacy for providing cross-undertaking by the claimant if he does not want the ship to be released, examines the status quo of the legal framework in China and puts forward some suggestions.
