摘 要:《海商法》及《物权法》对船舶物权变动的规定采登记对抗主义,加之航运实践的需求,船舶登记所有人与实际所有人相分离的情况十分普遍。在船舶登记所有人的债权人向海事法院提起海事请求保全时,因海事请求保全采形式审查方式,会产生船舶虽非诉讼争议标的而被扣的情形,船舶实际所有人的船舶所有权及应得船舶利益遭受威胁。该文以司法实践中船舶实际所有人欲通过确权之诉对抗船舶保全的案例引发的法律思考为起点,对案外人执行异议之诉在海事请求保全中的适用困境进行剖析,创造性地提出在《海事诉讼特别程序法》修改时引入案外人执行异议之诉制度的思路与建议。It is common for ship registration owners to be separated from the actual owners, as the Maritime Law of the People’s Republic of China and the Property Law of the People’s Republic of China regulate the change of ship property rights under registration confrontation doctrine and there is a need in shipping practice. When the creditor of the ship registration owner applies to the maritime court for maritime claim preservation, it will result in arrest of ship despite the non-litigation dispute on ships. This is because the preservation for maritime claims adopts formal examination. The actual owner’s ownership and the deserved interests of ship in question are thus threatened. This paper starts with the legal thinking caused by the case that the actual owner of ship challenges ship preservation through confirmation of right in judicial practice,analyses the applicable dilemma in the preservation for maritime claims, and creatively proposes suggestions for introducing outsiders to implement the system of opposition appeal when the Special Maritime Procedure Law of the People’s Republic of China is amended.
