摘 要:从深层次上说,法律作为道德的底线其实就是底线的道德,它是道德的一种特殊形式,所以,法治和德治归根结底都是道德治理。但是,法律是一种特殊的道德,法治因而也是一种特殊的治理。在逻辑上,我们不能绝对地说应该法治优先还是德治优先,因为这可能导出违背历史事实的结论。若要分析法治优先还是德治优先,必须把相关分析置于具体的历史之中。但是,在逻辑上分析法治和德治各自的特征和优势,是我们进行历史考察的基础,当我们把逻辑分析的结果置于特定社会的历史文化背景和具体道德环境之中进行考察时,我们或许就能相对合理地得出法治优先还是德治优先的结论。In the deeper sense,law as the bottom line of morality is actually the morality of the bottom line.It is a special form of morality.Therefore,both the rule of law and the rule of virtue are moral governance.However,the law is a special kind of morality,and the rule of law is also a special kind of governance.Logically,we cannot say absolutely whether the rule of law should be priority or the rule of virtue,because this may lead to conclusions that are contrary to historical facts.To analyze whether rule of law should be priority or the rule of virtue,the logic analysis must be placed in a specific history.However,the logical analysis of the characteristics and advantages of the rule of law and the rule of virtue is the basis for our historical investigation.When we place logic analysis in the historical cultural context and the specific moral environment of a particular society,we may be able to draw a relatively reasonable conclusion of priority about the rule of law or the rule of virtue.
