大学教师权益损害的救济机制研究

摘  要:随着教师聘任制度的实施,权益救济成为我国高校教师维护权益的一种必要手段。目前我国大学教师权益救济机制存在教育法律体系不完整、部门行政法规缺位、部门规章制度越位以及法律法规不一致等诸多问题。这些问题导致了高校教师面临内部行政纠纷时“求告无门”,劳动人事权益受损案件的司法审查问题凸显,司法救济渠道与其他救济途径之间存在隔离,大学自主办学权与司法干预之间不平衡等现象。这需要加强高校教师权益非司法救济制度的完整性,建立司法救济与非司法救济渠道的协同机制,明晰司法审查标准与边界,确保司法监督权与大学自治权平衡。With the implementation of the teacher appointment system,the judicial relief mechanism has become a necessary means to relieve the rights and interests of university teachers in China.At present,there are many problems in the judicial relief mechanism of university teachers'rights and interests,such as the incomplete educational legal system,the absence of administrative laws and regulations,the offside of departmental rules and regulations,and the inconsistency of laws and regulations.These problems lead to the phenomenon of"no access to appeal"when university teachers face internal administrative disputes,the problem of judicial review in cases of damaged labor and personnel rights and interests,the separation between judicial relief channels and other relief channels,and the imbalance between university autonomy and judicial intervention.This requires strengthening the integrity of the non-judicial remedy system for the rights and interests of university teachers,establishing a cooperative mechanism between judicial remedy and non-judicial remedy channels,clarifying the standards and boundaries of judicial review,and ensuring the balance between judicial supervision and university autonomy.
