摘 要:案外人租赁权设立在不动产抵押登记之后,法院查封之前的,考量各方当事人的根本诉求有利于解决被查封的不动产抵押权和租赁权的冲突,进行立法统一。此类案外人执行异议之诉案件,应当明确法院审查租赁合同的效力,综合判断租赁权成立的时间,并不审查承租人和出租人、受让人的纠纷,仅仅根据当事人的主张和证据在判决中判决是否负担租赁权拍卖,建议赋予抵押权人和用来商业使用的承租人的租赁关系去除请求权以及规定其举证责任。When the leasehold of an outsider is established after the registration of the real estate mortgage and before it is sealed up by the court,considering the fundamental demands of all parties concerned,it is conducive to resolving the conflict between the mortgage and leasehold on the real estate that is sealed up,so as to achieve legislative unification.Such an outsider execution objection lawsuit cases,we shall specify the court to review the validity of the leasing contract,coincide with the establishment of the comprehensive judgment lease does not review the lessee and the lessor,the assignee of the dispute,only according to the claims of the parties and the burden of evidence in his ruling,the ruling whether the lease sale.I suggest that giving the mortgagee and used for commercial use of the lessee’s lease relationship for removal and the burden of proof.
