文学与法律:跨学科研究中的困惑、误区及理性回归

摘　　要：文学家与法学家身份的非个案式重合,在一定程度上为文学与法律的跨学科研究提供了合法性基础,由此文学与法律对话的可能性以及如何开展二者的跨学科研究的问题开始被关注。于是有法学研究者对此发声,并且在"经济学包围"的压力下越过可能性的探讨而径直跨跃到了二者的跨学科研究。然而缺失了"可能性"探讨为前提的跨学科研究无疑是一种"意念先行"的预设式研究,同时"情急"之下展开的比较探讨,难免会成为"轻率的概括""表面化的理解"和"偏见的解释"。这不仅使得"跨学科研究的对象"变得含混不明,而且基于学科之间天然的或偶然的相似性而展开的所谓"跨学科视角"的研究实为"专业视角"的单一学科透视,还使得文学与法律学科之间的关联性和共同性被放大而差别性遭到忽视,从而导致对这两门学科双向的误读与曲解,得出一些空泛松软的"先验"式的结论。因此,真正基于文学与法律的跨学科研究,正期待着合理框架内的理性回归。The non-case overlap of Litterateur and Jurist identities provides a legality basis for the interdisciplinary study of literature and law to a certain extent. Therefore, the possibility of dialogue between literature and law and how to carry out the interdisciplinary study of the two have begun to attract attention. So some law researchers voiced on this issue, and under the pressure of "encirclement of legal economics", they leaped over the discussion of possibilities to the interdisciplinary study of the two. However, without the premise of probing into "possibility", interdisciplinary research is undoubtedly a presupposed study of "idea-first". At the same time, the comparative study under "urgency" will inevitably become "imprudent generalization", "superficial understanding" and "biased interpretation". This not only makes the "object of interdisciplinary study" obscure, but also makes the so-called "interdisciplinary perspective" based on the natural or accidental similarities between disciplines a single disciplinary perspective of "professional perspective". It also enlarges the relevance and commonality between literature and law disciplines while ignoring the differences, Misreading and misinterpretation leads to some vague and loose "priori" conclusions. Therefore, the interdisciplinary study based on literature and law is looking forward to a rational return within a reasonable framework.
