摘 要:本文通过对1999-2016年发生的78个高校教育惩戒诉讼的分析,发现近年来高校教育惩戒诉讼增速明显,教育惩戒纠纷类型多样且以身份性惩戒纠纷为主。由于惩戒依据越权或过于笼统、过度或违反程序行使惩戒权等原因,造成高校败诉率居高不下。高校应积极应对教育惩戒诉讼,通过提高学生管理人员的法律素养、加强规章制度建设、引入正当程序与比例原则等方式,将教育惩戒纳入法治化轨道,避免对学生权利造成侵害。Based on the analysis of 78 school educational disciplinary actions that occurred between 1999 and 2016, this paper finds out that in recent years, the rate of disciplinary actions in colleges and universities has increased significantly. There are various types of educational disciplinary disputes especially those called"identity disciplinary disputes". It is because of the vagueness of disciplinary basis and the abuse of punishment power as well as the violation of procedures that brought a high rate of losing for schools in court. To cope with such situation, schools should actively respond to educational disciplinary actions in order to avoid the infringement on students’ rights and bring educational discipline into the track of the rule of law by means of enhancing the legal literacy of school staffs, drafting related rules and regulations as well as introducing due process and proportional principle.
