新冠肺炎疫情防控中的“相称性原则”解析

摘　　要：在突发公共卫生事件的应急处理中相应的要遵循相称性原则:干预措施要行之有效;干预应该是必要的且对个体权益的损害是最小限度的,采取防控措施的公共收益应与造成的损失相称;新冠肺炎疫情防控措施要适当,应把握好抗疫舆论报道的尺度,实现疫情防控与生活生产活动之间的动态平衡,处理好疫情报告、信息发布和保护隐私之间的关系;还应发挥相称性原则在突发公共卫生事件应急响应中的指导作用,完善国家应急管理法律。This paper discussed that the principle of proportionality should be followed in response to public health emergencies,including:the intervention measures should be effective;the intervention should be necessary and the damage to individual rights and interests should be minimal,and the public benefits of prevention and control measures should be commensurate with the losses caused.The prevention and control measures of the COVID-19 outbreak should be appropriate.The scale of public opinion reporting against the epidemic should be well controlled.A dynamic balance between epidemic prevention and control and domestic production activities should be achieved.The relationship between outbreak reporting,information dissemination and privacy protection should be well managed.Meanwhile,the principle of proportionality should play a guiding role in the emergency response of public health emergencies,and the law of emergency management should be improved.
