摘 要:“尧不能训丹朱”,舜将其父“窃负而逃”及孔子“父为子隐,子为父隐”都是“亲亲相隐”的案例。它不仅对我国古代法律上容隐权的形成有重要影响,而且对正确处理伦理关系、民族关系及阶级关系、政党关系等也都有用武之地。在目前构建人类命运共同体和“一带一路”的建设中也有重要的启发和借鉴意义。从哲学上说,它属于事物中对立双方的统一性的范畴,对它的考察研究有利于对矛盾双方的统一性的认识与研究。“Yao’s failure to teach his son Dan Zhu”,Shun“stole to escape with his guilty father”and“father will shield his son and vice versa”as stated by Confucius are examples of“kinship shield”,which not only has an important impact on the formation of concealing rights in ancient China,but also has a role to play in the correct handling of relations of ethics,and those among different ethnics,classes and parties.It is also of revelational and referential significance in the construction of a community with shared future for mankind and the construction of the“Belt and Road”.From a philosophical perspective,it belongs to the category of unity of the opposite parties,and its investigation and research is conducive to our understanding of and study on unity of contradictions.
