摘 要:房屋买卖合同网签备案(网上签约和网上备案)是我国特有的制度。它源自商品房预售合同登记备案,随着网络信息技术发展而成型,与不动产登记截然不同。网上备案以市场监管为主要功能,不动产登记在现实中未承担这一功能。通过与房屋所有权转移登记的挂钩,网上备案在实践中还有保护购房人债权的功能,从而与预告登记功能重叠。网上签约的主要功能是提供市场服务,对于房屋买卖合同的协商、签订、履行均有相当的助益。为了实现既有制度功能的最大化,可实质结合网签备案和预告登记,使其二者能同时启动办理。The regulation for online house-purchasing contracts and record is a unique system in China.It originates from the registration and registration of pre-sale contracts for commercial housing.It has taken shape with the development of network information technology and is completely different from real estate registration.The main function is market monitoring for online record while the real estate registration cannot realize this function in the real world.In addution,online record could protect claims of purchasers by the connection with the real estate registration so as to realize the duplication of functions with advance notice registration.As for online house-purchasing contracts,the provision of services for the market is the main function that is beneficial for the whole purchasing process including negotiation,agreement and performance of house-purchasing contracts.In order to maximize functions of contemporary regulations,it is advised to combine essentially online house-purchasing contracts and record with advance notice registration by registering both synchronously.
