论我国动物源食品执法信息社会化运用机制的完善

摘　　要：在包括动物源食品内的食品安全领域中,执法信息本可作为私人维权的重要线索和优质证据,但实践情况不尽如人意。究其原因:相关执法信息缺乏标准化的技术方法,公开的流动性程度不高;在信息来源方面,未区分反映经营义务和事后责任的信息类型,造成多种信息混同公开而公众无力选择的困境;在公开渠道建设方面,政商电子平台间的信息沟通不畅。上述反映了我国食品信息公开制度在理念和规则上存在一定问题,应当重塑食品执法信息既服务行政履职,又回应公众需求的制度理念,根据食品经营环节来确定信息所承担的内容,并据此在融合政务、电商平台资源基础上,实施分类型、分时序信息公开,提高执法信息社会化运用的效果。For the field of food safety including animal-derived food,law enforcement information could be used as an important clue and high-quality evidence for the protection of individual rights,but had been seldom satisfactory in practice due to the following reasons:standardized technological methods were missing in relevant information,with poor degree of mobility;for the information sources,the types of information reflecting business obligations and post-event responsibilities were not distinguished,which caused the dilemma that a variety of information was mixed and publicized while the public was unable to select;for the construction of public channels,political and business electronic platforms failed to communicate with each other.According to above analysis,certain questions were shown in the concept and rules of food information disclosure system in China.Some suggestions were put forward as follows:the concept of law enforcement information concerning food that not only served the execution of administrative duties but also responded to the public's demand should be reshaped,the information content should be determined according to the process of food business,measures for disclosing information should be taken according to its corresponding types and time sequence based on the integration of resources concerning government affairs and e-commerce platforms,so as to improve the effect of socialized application of law enforcement information.
