我国反洗钱与反恐怖融资金融情报信息交换机制优化研究——基于国际标准的视角

摘　　要：作为反洗钱与反恐怖融资领域的主要国际标准,《金融行动特别工作组建议》在我国的全面实施既有利于我国优化完善自身的反洗钱与反恐怖融资金融情报信息交换机制,也有助于我国稳步加入金融情报机构埃格蒙特集团。本文通过分析、梳理金融情报信息交换与合作的国际标准,并与我国金融情报信息交换与共享的现实情况进行对照,剖析了当前存在的相关问题。参照金融情报信息交换国际标准,结合我国反洗钱与反恐怖融资的工作实际,本文建议,应重点从合理确定金融情报机构的法律地位、整合协调金融情报机构体系、扩大金融情报信息收集存储功能、改进部门间金融情报信息共享、加强金融情报信息交换国际合作以及突出反恐怖融资情报信息合作六方面入手,进一步推进我国的反洗钱与反恐怖融资金融情报信息交换工作的优化完善。As the main international standard in the field of AML&CTF,the full implementation of the FATF recommendations in China will not only help China optimize and improve its own exchange mechanism of financial intelligence,but also help China to steadily join the Egmont Group,a financial intelligence agency.This paper analyzes and sorts out the international standards of exchange mechanism of financial intelligence and cooperation,then compares with the reality of China's information exchange and sharing of financial intelligence,and finally analyzes the existing problems.It is suggested that the China's exchange mechanism for financial intelligence of AML&CTF should be improved by establishing a reasonable legal status for the national financial intelligence unit,integrating and harmonizing the components of the national financial intelligence unit,expanding its function in collecting and storing financial information,enhancing information exchange between the relevant authorities,strengthening international cooperation in financial information exchange,and attaching greater significance to intelligence cooperation on CTF,in accordance with the international standard for financial intelligence exchange,considering China's specific situations in AML&CTF.
