组织考试作弊罪完成形态探析

摘　　要：刑法修正案(九)增设组织考试作弊罪,但在司法实践中对该罪的认定仍然存在争议。如何正确区分组织考试作弊罪的各种形态,关键在于准确认定组织考试作弊罪实行行为的着手和终了。判断组织考试作弊罪的着手,必须对组织行为进行厘清。组织行为是指通过招募、雇佣、纠集、引诱、介绍、强迫等手段,领导、策划、指挥他人在法律规定的国家考试中实施考试作弊行为,被组织的人数不影响该罪的着手认定。对于组织考试作弊罪既遂的判断应采取折中说,从组织行为和被组织行为2个方面判断实行行为是否终了,即在组织行为已经完成的基础上,以被组织的考试作弊行为是否已经渗透至相对封闭的考场为标准进行判断。The Criminal Law Amendment(Ⅸ)adds the crime of organizing cheating in examinations,but the determination of this crime is still controversial in judicial practice.How to distinguish the various forms of organizing the crime of cheating in examinations is the key to determine the beginning and end of the practice of organizing the crime of cheating in examinations.In order to judge the crime of organizing cheating in examinations,we must make clear the way of organizing behavior.“Organizational behavior”refers to leading,planning and instructing others to cheat in the national examinations stipulated by law by means of recruitment,employment,gathering,seduction,introduction and coercion.The number of persons organized does not affect the determination of the crime.To judge the accomplishment of the crime of organizing examination cheating,we should adopt the compromise theory,which is to judge whether the practice behavior is finished from the two aspects of the organizational behavior and the being organized behavior,that is,on the basis of the completion of the organization behavior,to judge whether the organized examination cheating behavior has penetrated into the relatively closed examination room as the standard.
