再论我国征地补偿制度之缺陷及完善

摘　　要：我国征地补偿制度几经变迁,但仍存在征地补偿的一次性与土地生存保障功能的长久性相冲突和征地补偿的可衡量性与土地生存保障及其他价值的不可衡量性相冲突的问题。同时,该制度还面临农村集体经营性建设用地入市与农地“三权分置”的反向冲击问题。在城乡二元结构体制和土地二元所有制长时期存在的背景下,未来征收补偿制度的发展应当引入土地发展权,研究清楚农地增值的根本原因,并以补偿的持久性和完全性为原则来指引补偿的项目、形式、标准以及给付方式。After several changes,there are still some problems in the compensation system of land expropriation in China,such as the conflicts between one-time land expropriation compensation and the long-term land survival security function,the conflicts between the measurability of compensation for land expropriation and the measurability of land survival security and other values.At the same time,the system also is faced with the negative impact of the entry of rural collective commercial construction land into the market and the "three rights division"of agricultural land.Under the background of dual structure system of urban and rural areas and dual ownership of land for a long time,the development of expropriation and compensation system in the future should introduce the right of land development,investigate the root causes of farmland appreciation,and guide the arrangement of compensation items,forms,standards and payment methods with the principle of durability and completeness of compensation.
