摘　　要：大学章程对于大学法人的宪章性、标志性地位和作用在理论认识上已经达成共识,但是在现实中,大学章程无论制定上还是运行上,大多都是国家政策和行政命令推进的结果,与大学组织的学术自治本性和治理逻辑不适应。依法治校应该从制定科学合理的大学章程开始。重申建设自治、法治、共治的现代大学制度,必须抓住大学章程建设这个“牛鼻子”。以湖南省54所高职院校大学章程文本为分析对象,检视高职院校依章程治理存在办学治理权缺乏活力、内部治理结构不健全、高职院校法治水平不高等现状,提出明晰学校与政府、社会的关系以激发办学活力、明确学校法人类型以完善法人治理结构、加强大学章程合法性地位以提升学校法治能力等建议,逐步实现高职教育现代化。University regulation have reached a consensus on the charter,symbolic status and role of university legal persons in theory understanding.However,in reality,most of the university regulations are the result of the promotion of national policies and administrative orders,which are incompatible with the academic freedom nature and the logic of governance organized by universities.Running the university according to law should start from the formulation of scientific and reasonable university regulations.It is a must to reiterate the construction of university regulations,which is like the"bull nose",in order to build a modern university system of autonomy,rule of law and co⁃governance.Based on the articles of association of 54 Higher Vocational Colleges in Hunan Province,this paper examines the current situation of the lack of vitality of school governance right,the imperfection of internal governance structure,and the low level of rule of law in higher vocational colleges.It proposes to clarify the relationship among the school,the government and society to stimulate school vitality,clarify the types of school legal person to perfect corporate governance institutions and strengthen the legitimacy of university regulation to enhance the legal ability of universities,so as to realize the modernization of higher vocational education step by step,.
