摘 要:行政诉讼举证责任分配的基本规则应当是“谁主张,谁举证”,但在行政行为合法性举证上,实行举证责任倒置,由被告负举证责任。作为行政诉讼“子诉讼”的行政公益诉讼,在《行政诉讼法》没有作出特别规定的情况下,应当适用行政诉讼的一般举证责任分配规则。检察机关对违法行政行为或者不作为侵害公共利益的事实进行举证,承担的是推进责任而非说服责任,其提供的证据应当是初步证据,证明程度或者标准不要求达到确证程度。The basic rule of the distribution of burden of proof in administrative litigation should be"who claims,who bears the burden of proof".However,the burden of proof is inverted in proving the legality of administrative act,and the burden of proof is bome by the defendant.Administrative public interest litigation,as a"sub-litigation"of administrative litigation,shall apply the general rules on the distribution of burden of proof in administrative litigation in the absence of special provisions in the Administrative Procedure Law.To provide evidence for the fact that illegal administrative acts or omissions infringe on public interests,procuratorial organs bear the responsibility of promoting rather than persuading.The evidence they provide should be preliminary evidence,and the degree or standard of proof does not require to reach the degree of corroboration.
