摘 要:目前,我国国家层面没有老年教育专项立法,地方层面也一直未有新的老年教育条例出台,而已有的两部老年教育条例的调整对象和立法目标又陷入混乱之中,这种情形对老年教育的可持续化发展极为不利。因此,无论是国家专项立法,还是地方特别立法,应遵循老年教育的学科理念,依据《教育法》《老年人权益保障法》明晰思路,科学设定立法的调整对象,并对老年教育的概念进行准确而周延的界定;立法目标是为了保障老年人继续学习的权利,构建终身化老年教育体系并促进个体健康而成功地老龄化,再辅以公平性、公益性和开放性的一般立法原则,以及包容性、可选择性和赋权增能的特殊立法原则,完成法律文本的设计与构建。At present,there is no special national legislation on the elderly education and no new local regulations on education for the elderly.The adjustment objects and the purposes of the two existing regulations for the elderly have fallen into confusion,which is extremely unfavorable to the sustainable development of education for the elderly.Therefore,either the national special legislation or the local special legislation should follow the academic philosophy of education for the elderly,clarify the thoughts according to the Education Act and the Law on the Protection of the Rights and Interests of the Aged,scientifically set the adjustment object of the legislation,and accurately define the senior-citizen education.The aim of legislation is to guarantee the rights of the elderly continuing to study,to construct lifelong educational system for the aged and promote the individual aging healthily and successfully,coupled with general legislative principles of fairness and public welfare and openness,as well as special legislation principles of inclusiveness,selectivity and empowerment,to complete the design and build the whole legal text.
