“行动中的法”教学理念及其实践展开--以美国威斯康星大学法学院为例

摘　　要：“行动中的法”作为美国威斯康星大学法学院的教学传统,既是对哈佛案例教学法的改革创新,亦是对教育必须为社会服务的“威斯康星理念”的具体贯彻。它要求学生不仅要了解“书本上的法”,更要关注法律的演进和发展,以及它们在现实社会中的实际运作及其效果。正是在这一理念引领下,威斯康星大学法学院的教学在美国独具特色,实验教学、诊所课程、专门的实务技能课程和专业实习相互配合,共同构成完整的“行动中的法”实践教学体系,并使该学院的法律教育位居美国前列,在服务地方社会、促进经济发展方面做出了自己的贡献。这种社会实践面向的教学模式,对于我国法治建设新时期的法学教育教学改革具有借鉴意义。As a teaching tradition of the Law School of University of Wisconsin,“Law in Action”is not only a reform and innovation of Harvard case method,but also a specific implementation of the“Wisconsin Idea”that education must serve the society.It requires students not only to understand the law in books,but also to pay attention to the evolution and development of law,as well as their actual operation and effect in the society.Under the guidance of this concept,the education at the Law School of University of Wisconsin has its own characteristics and achievements in the United States.The experimental teaching,clinical courses,specialized practical training courses and professional practice cooperate with each other to form a comprehensive practical teaching system of“Law in Action”which successfully keeps the legal education of the University of Wisconsin at the forefront of the United States,making its own contribution in serving local social and economic development.This kind of practice-oriented teaching mode owns great significance for the reform of legal education in the new era of constructing rule of law in China.
