摘 要:尽管我国现行法律法规没有明确规定现代学徒制模式下学徒的学校学生和企业员工双重身份,但我国现行政策却有明确规定且与现行法律法规并不冲突,所以学徒的双重身份在法理和政策上都是成立的;即使不考虑现行政策的规定,单从学徒“岗位实践”性质上分析,也可以得出学徒为合作企业提供劳动并获得企业员工身份的结论;从法律关系的兼容性上看,学徒具有学校学生和企业员工双重身份,且这两种身份互不排斥、同等并重。There’s no clear regulation regarding the dual identity of apprentice in modern apprenticeship under current Chinese law.However,it is clearly stipulated in government policy and does not contradict current laws,therefore,dual identity of apprentice is true in both law and policy.Conclusion can be drawn from mere analysis of post practice of apprentice that apprentice provides labor and works as employee for relevant enterprise regardless of current policy.In view of compatibility of legal relation,apprentice has dual identity of both school student and enterprise employee and the dual identity is not mutually exclusive but of equal importance.
