相对消极型合适成年人在场制度的构建

摘　　要：合适成年人在场制度对保护未成年人的合法权益具有重要意义,基于对该制度实践状况的考察,发现了部分存在的问题。据此,提出借鉴律师在场制度及亲情会见制度以构建相对消极型合适成年人在场制度,即在办案机关询问、讯问未成年人的过程中,合适成年人除特殊情况外应维持倾听状态,而在办案人员请求或经办案人员允许的情况下积极地对未成年人进行教育、抚慰、帮助,此外还包括统一座次设置和对妨碍正常办案的行为的应对。相对消极不是全面消极,而是为了能够在阻力较小的情况下,推动合适成年人在场制度的实质化,通过健全相关制度、保障合适成年人异议权、严格非法证据排除、加强治安案件监督等,最终实现对儿童最大利益原则与司法效率的兼顾。The system of appropriate adult’s presence is of great significance to protect the legitimate rights of juvenile offenders,but several problems have been discovered during the field inspection of the system.On the basis of this,it is proposed that a relatively negative system of appropriate adult’s presence should be constructed by using the system of lawyer’s presence and the family members’interview system for reference.Namely,while a case-handling officer is inquiring or interrogating a juvenile,an appropriate adult present should maintain a listening state except for special circumstances,but provide active education,comfort,and assistance to the juvenile at the case-handling officer’s request or under his permission.In addition,the system also includes unified seating arrangements and responses to behaviors that hinder the normal handling of the case.The relative negativity here is not complete negativity,it aims to promote the substantialization of the system of appropriate adult’s presence under fewer obstructions,and finally realize the balance between the Children’s Best Interest Principle and judicial efficiency through improving relevant systems,guaranteeing the appropriate adult’s right to disagree,strictly excluding illegal evidence,enhancing the supervision on public security cases,etc.
