摘　　要：墨子的法律价值观主要体现为:尚法法天的法律至上观、为仁兼爱的良法善治观、义正尚同的法律正义观、兴利利民的法律权益观和谈辩中效的法律商谈观。墨子的法律价值观以中国法律文化的“小传统”彰显了中国现代法律文化的“大传统”,映射着现代法律价值观的法律至上、仁爱兼爱、公平正义、义利相容和辨明析理等内涵。弘扬“尚法法天”,促进法治意识的养成;光大“仁法”“治法”,助推良法善治;传承“义正尚同”,树立公平平等的法律正义观;倡导“兴天下利”的权益观,确保法治为民和保障民权;借鉴“谈辩明理”的法律商谈,完善中国特色的民主法治,实现墨家法律价值观的“创造性诠释”和“创造性转化”,为良法善治和法治建设,提供最为原创的“法治本土资源”。Mozi's legal values are mainly manifested in:the supreme view of law,the supremacy of law and heaven,the good law and good governance view of benevolence and love,the legal equality view,the legal rights and interests view of prospering the interests and the people,and the legal negotiation view of debate and effectiveness.Mozi's legal values with“little tradition”of the Chinese legal culture in the“great tradition”of modern Chinese legal culture reflect the creative interpretation and creative transformation of the legal values of Mohist school from the perspective of law supremacy,benevolence and universal love,fairness and justice,righteousness and benefit,and reason and discrimination.We should promote the formation of the consciousness of rule of law by carrying forward“upholding law and heaven”;uphold“benevolent law”and“governing law”to promote good law and good governance;inherit“justice equality”and establish the concept of legal justice of fairness and equality;advocate the concept of rights and interests of“prospering the world and benefiting the people”,ensure the rule of law for the people and protect civil rights,and learn from the legal discussion of“talking and reasoning”to improve the democratic rule of law with Chinese characteristics,so as to realize the“creative interpretation”and“creative transformation”of Mozi's legal values,and provide the most original“local resources of the rule of law”for good law and good governance,and for the construction of the rule of law.
