职务犯罪调查阶段认罪认罚从宽制度适用问题研究

摘　　要：职务犯罪的特殊性、诉讼效率的提高、当事人合法权益的保护以及宽严相济刑事政策的有效贯彻,都需要在职务犯罪调查阶段积极贯彻认罪认罚从宽原则,但是由于法律规定的过于原则和抽象,导致认罪认罚从宽原则在适用过程中存在诸多问题:法律性质、定位以及监察机关权限不明确;被调查人认罪认罚的自愿性难以保障;证据收集的合法性难以保证以及法律规范之间衔接不畅。基于此,笔者认为,应对监察机关适用认罪认罚原则的法律性质、定位、权限予以明确,建立值班检察官和律师介入制度,强化检察机关实质化审查机制,加强监察人员队伍建设,进而尽量克服认罪认罚从宽原则在职务犯罪调查阶段适用过程中存在的弊端,最大化地发挥认罪认罚从宽制度价值。The particularity of job-related crimes, the improvement of litigation efficiency, the protection of the legitimate rights and interests of the parties and the effective implementation of the criminal policy of tempering justice with mercy all need to actively implement the principle of leniency in confession and punishment in the investigation stage of job-related crimes. However, due to the too principled and abstract legal provisions, there are many problems in the application of the principle of leniency in confession and punishment: legal nature unclear positioning and authority of supervision organs;the voluntariness of the respondent’s confession and punishment is difficult to guarantee;the legitimacy of evidence collection is difficult to guarantee and the connection between legal norms is not smooth. Based on this, the author believes that we should clarify the legal nature, positioning and authority of the application of the principle of confession and punishment by supervisory organs, establish the intervention system of on duty prosecutors and lawyers, strengthen the substantive review mechanism of procuratorial organs, and strengthen the construction of supervisors, so as to overcome the disadvantages of the principle of leniency in the application of the principle of confession and punishment in the stage of job-related crime investigation, maximize the value of the leniency system of confession and punishment.
