营商环境建设中司法保障机制研究——基于201件非法集资类犯罪案件的实证分析

摘　　要：近年来,我国民间非法集资的发展势头迅猛,且大案要案频发。打击、处置非法集资工作面临的形势极为严峻。笔者对L省S市近5年非法集资类案件裁判文书进行统计,发现5年来S市非法集资类案件投资人损失金额高达44.74亿元,年平均损失8.95亿元。由于非法集资类案件往往涉及地域广泛、投资人数众多、涉案金额巨大,严重影响了社会稳定和广大人民群众的切身利益。分析梳理近年来非法集资类案件的裁判文书,从犯罪数额、参与人数、集资手段、被告人辩解、定罪量刑等多个角度进行深入研究,有助于加强打击和预防非法集资类犯罪行为的针对性,保护合法民间融资行为的同时解决司法实践中存在的问题,维护社会金融秩序的稳定,为服务法治化营商环境建设提供有益的探索。In recent years,the development of illegal private fund-raising in China has been growing rapidly,and major and important cases have occurred frequently.The situation in combating and dealing with illegal fund-raising has been extremely severe.The author made statistics on the judgment documents of illegal fund-raising cases in S City,L Province in the past 5 years,and found that the amount of investor losses in illegal fund-raising cases in S City in the past 5 years was as high as 4.474 billion yuan,with an average annual loss of 895 million yuan.Because illegal fund-raising cases often involve a wide range of regions,a large number of investors,and a huge amount of money involved,they have seriously affected social stability and the vital interests of the broad masses of people.Analyze and sort out the judgment documents of illegal fund-raising cases in recent years,and conduct in-depth research from multiple angles such as the amount of crime,the number of participants,fund-raising methods,defendants’defense,conviction and sentencing,etc.,which will help strengthen the combat and prevention of illegal fund-raising crimes.It protects legal private financing behavior while solving problems in judicial practice,maintaining the stability of social financial order,and providing useful explorations for the construction of a legalized business environment.
