摘  要:教材建设国家事权是一个政治命题、教育命题,同时也是一个法理命题。70余年教材建设历程所蕴含的政治性话语、人民性话语、法律性话语、文化性话语和实践性话语已烙上鲜明的法理印记,且这种“暗隐但从未消退”的法律属性早已成为教材建设国家事权学理基础的关键特质和重要表达。作为教材建设国家事权的法理基础,中国特色社会主义法治理论在贯穿教材建设落实国家事权的进程中遭遇了如教材建设“一般授权”路径依赖追问、非统编教材落实国家事权的“效果史”检讨、共益定性的教材建设激励约束机制省思等法理风险。化解教材建设国家事权落实的诸多风险,可从加快推进教材建设的法律法规体系建设、提高教材建设国家事权落实主体的法治意识、加强教材建设国家事权的法理基础研究等进路着手,以此来保障教材建设国家事权的依法落实。The construction of teaching materials as a state authority(CTMSA)is not only a political proposition,an educational proposition,but also a legal proposition.The political discourse,popular discourse,legal discourse,cultural discourse and practical discourse contained in the construction of teaching materials for more than 70 years have been branded with a distinctive mark of jurisprudence,and this“hidden but never subsided”legal attribute has long become the key characteristic and important expression of the theoretical foundation of CTMSA.As the legal basis of CTMSA,the theory of the rule of law with Chinese characteristics has encountered some legal risks in the course of carrying out CTMSA,such as being questioned the path dependence of“general authorization”in the construction of teaching material,reviewing the“effect history”of implementing state authority in non-unified textbooks,and reflecting the incentive and restraint mechanism in the construction of teaching materials.To resolve the risks in the implementation of CTMSA,we can start with the legislative work of accelerating the construction of teaching materials,improve the legal awareness of the implementation body of CTMSA,strengthen the research of legal basis of CTMSA,and guarantee the legal implementation of CTMSA.
