摘 要:调岗作为企业用工自主的必备措施与劳动权保护有着紧密联系。从调岗权的学理基础追溯其背后的法益互动与劳资利益立场,有助于厘清调岗行为的辐射影响。通过实证分析梳理我国不同地区调岗类型及裁审规则的差异,得出结论:应立足本土实践并借鉴域外理论成果与实践经验,从调岗约定的效力及调岗权利的边界与实施幅度考量制度设计的合法性与合理性,探究把握平衡点的路径选择和利益衡量的原则,实现利益平衡中的合理性与正当性,从而更好地规避风险、合规用工、协调劳资利益关系。As a necessary measure of employment autonomy,job transfer is closely related to the protection of labor rights.From the academic basis of post transfer right,the interaction of legal interests and the position of labor and capital interests behind it are traced so as to clarify the radiation influence of post transfer behavior.Through the empirical analysis,the differences of the judgment of the legality of post assignment in different cases are sorted out.Taking the principal contradiction as the entry point,summarize the factors and proof points.The system design will base on local practice and draw lessons from foreign practice to consider the legality and rationality of the post transfer agreement from two aspects:the validity of the post transfer agreement and the boundary and implementation range of the post transfer right.Explore the path selection about how to grasp the balance point and the principle of interest measurement to realize the rationality and legitimacy in the balance of interests,so as to better avoid risks,comply with labor employment and coordinate the relationship between labor and capital interests in practice.
