摘 要:以涉身主体性视角重新审视死亡观,试图打破身体性的传统死亡伦理的桎梏,对脑死亡标准合法化问题进行探讨。揭示涉身主体性死亡观之直面死亡,是脑死亡标准合法化的科学前提;涉身主体性死亡观之关注“身体”,是脑死亡标准合法化的人文基石;涉身主体性死亡观之生死整体性,是脑死亡标准合法化的伦理基础。传统死亡观从身体性向涉身主体性转变的伦理运动,应在尊重的基础上合理地引导,在积极的引导中循序渐进地践行,从而使脑死亡立法在我国得以可能。Reviewing the concept of death from the perspective of embodied subjectivity,this article attempts to break the limitation of the traditional body-rooted concept of death,and discusses the legalization of brain death standard.The death view of embodied subjectivity should face death directly,which is the scientific premise of legalization of brain death.The death view of embodied subjectivity should focus on the body,which is the humanistic foundation for the legalization of brain death.We should look at life and understand death as a whole,which is the ethical basis for legalizing brain death.In conclusion,the ethical movement should be guided reasonably on the basis of respect and practiced step by step under positive guidance,so as to speed up the process of brain death legalization in China.
