摘 要:高等教育立法是高等教育法治建设的重要环节,为高等教育高质量发展提供法律保障。中华人民共和国成立以来,我国高等教育立法先后经历了探索奠基、正式启动、全面推进、巩固深化与系统完善五个阶段,呈现立法理念人本化、内容拓展化、程序合法化、体制健全化等演进特征,反映立法诉求转至立德树人、视域聚焦治理体系、效益趋于常态提升、主体走向分权释能等演进逻辑。未来我国高等教育立法可通过维护多方权益,明晰高等教育行为主体权责界限;关注靶心效应,聚焦高等教育领域内重难点问题;加强内涵建设,健全高等教育立法运行保障机制;坚持联动思维,推动高等教育硬一软法混合治理等路径向前推进,从而保障和促进新时代高等教育事业的发展。The legislation on higher education is an important link of the construction of educational rule of law,and it provides legal guarantee for higher education to develop with high quality.Since the foundation of the People's Republic of China,the legislation on higher education has experienced five stages of exploration and foundation,formal initiation,comprehensive promotion,consolidation and deepening,and systematic improvement,which presents the evolutive features of humanization in legislative concepts,expansion of legislative content,legalization of legislative process,improvement of legislative system,and reflect the evolutive logic of legislation demand turning to strengthening moral education and cultivating people,legislative scope focusing on governance system,legislative benefits becoming normal promotion and legislation subject moving towards decentralization.The future of the legislation on higher education in China can be advanced by safeguarding multi-party rights,clearing the limits of the rights and responsibilities of higher education actors;paying attention to the target effect,focusing on the important and difficult problems in the field of higher education;strengthening the connotation construction,perfecting the guarantee mechanism of higher educational legislation;adhering to the linkage thinking,promoting the higher education hard-soft law mixed governance,so as to safeguard and promote the development of higher education in the new era.
