“文化自信”与公安队伍正规化建设——以原型平安文化理念“绝四”精神为视角

摘　　要：以"文化自信"为出发点,通过解剖公安机关一些刑事冤假错案件的办案过程,阐明孔子"毋意,毋必,毋固,毋我"的"绝四"精神在当今由"侦查中心"到"审判中心"转型的背景下公安队伍正规化建设的现实价值:"毋意"的强化证据意识价值;"毋必"的破案时限务实、立功缓行价值;"毋固"的自我纠错价值;"毋我"的权力、程序制约与忘我工作价值。最后阐述"绝四"精神的整体性与公安队伍正规化建设的贯联,认为"绝四"构成四位一体的次序循环链,其中的根子在"我"。"四弊"在,则办案发生偏离从而导致冤假错案;"四弊"除,则办案有望规范、准确,进而弄清事实真相,实现司法公正。Taking"cultural confidence"as the starting point,through an analysis of the criminal unjust cases of the public security organs,it is clarified that the practical value of Confucius’s"No pretend to be arrogant,no be arrogant,no hold your own opinion,no stand alone"spirit of"Abstain from four things"in the context of the transformation from"investigation center"to"judgment center":The value of"no pretend to be arrogant"to strengthen the awareness of evidence;the time limit of"no be arrogant,"is pragmatic and the value of meritorious deferment;the self-correction value of"no hold your own opinion";the power,procedural constraints and the value of selfless work of"no stand alone".Finally,it expounds the integration of the spirit of the"Absolute Four"and the regularization of the public security team.It is believed that the"Absolute Four"constitutes a four-in-one sequential circular chain,and the root of which is"I".If the"four malpractices"exist,the handling of the case will deviate and lead to unjust cases;if the"four malpractices"are removed,the handling of the case will be standardized and accurate,so as to clarify the facts and achieve judicial justice.
