摘 要:《中小学教育惩戒规则(试行)》以"不确定法律概念+空白要件"的形式为教育惩戒权行使留出较大的裁量空间和判断余地。教育惩戒裁量基准是指对《规则》中裁量事项的具体化,旨在为学校和教师在作出惩戒决定时提供判断选择标准。教育惩戒裁量基准发挥着为惩戒权行使提供具体化裁判标准、为受教育权提供能动性保护和实现惩戒权自我约束的多重功能。教育惩戒裁量基准应遵循过惩相当、平等对待和明确性的法治原则。建构教育惩戒裁量基准制度,应厘清裁量基准的创制主体与效力位阶,引入情节细化和效果格化的二元技术框架,并完善教育惩戒裁量基准中的程序性规则。in the form of"uncertain legal concept+blank elements",the code of educational discipline in primary and secondary schools(for Trial Implementation)leave a large space and room for judgment for the exercise of educational discipline power.Educational disciplinary discretion benchmark refers to the concretization of discretion matters in the rules,so as to provide judgment and selection criteria for schools and teachers when making disciplinary decisions.Educational disciplinary discretion benchmark plays multiple functions:providing specific judgment standards for the exercise of disciplinary power,providing initiative protection for the right to education and realizing the self-restraint of disciplinary power.The benchmark of educational punishment discretion should follow the rule of law principles of equal punishment,equal treatment and clarity.To construct the benchmark system of educational disciplinary discretion,we should clarify the creation subject and effectiveness level of the benchmark,introduce the dual technical framework of plot refinement and effect standardization,and improve the procedural rules in the benchmark of educational disciplinary discretion.
